Amicus Brief: Dray v. SIUH
The New York Civil Liberties Union submitted an amicus curiae brief in Dray v. Staten Island University Hospital to address the question of whether a hospital policy that singles out pregnant patients to override the fundamental right to refuse an unwanted medical intervention is unlawful sex discrimination under the New York City and State Human Rights Laws. The brief expands on why the Maternal Refusals Policy is sex discrimination based on pregnancy status under the NYCHRL and NYSHRL and detail how the lower court erred in concluding that documentary evidence exists to refute Ms. Dray’s claims.
