NYCLU Amicus Curiae Brief: Right to Interstate Travel

New York City’s effort through the present litigation to restrict the relocation of immigrants to the City violates the right to interstate travel. The NYCLU and ACLU Texas write concerning the application of this critical constitutional right to the statute.

Everyone, whether citizen or not, has the right to travel and reside anywhere within the United States, including Texas and New York. Texans and New Yorkers deserve better than xenophobia and discrimination masquerading as policy, and our leaders should refocus their energy from political shell games toward proudly and collectively managing the humanitarian challenges we face. This Court must reject the City’s attack on the fundamental right to travel.
