Police Benevolent Association of the City of New York, Inc. et al v. City of New York et al

The NYCLU filed an amicus brief in a federal lawsuit brought by the Police Benevolent Association attempting to bar the Civilian Complaint Review Board from providing disciplinary records in response to FOIL requests that include unsubstantiated complaints against named NYPD officers in cases of racial bias, sexual misconduct, or false official statements.

The brief argues that the 2020 repeal of 50-a and revisions to FOIL explicitly require the disclosure of this information and that the release of this information does not violate the due process rights of officers because disclosure does not deprive them of any tangible interest or property right.
