The NYCLU filed an amicus brief to provide critical context about the history of the I-81 viaduct and offer arguments to support a just environmental framework going forward. Specifically, the NYCLU asserts that the original construction of I-81 was rooted in racially discriminatory policies and produced adverse economic, social, and environmental harms that impact Black Syracuse residents, stresses that the Community Grid is the most equitable option available and is best positioned to promote important environmental justice objectives, and asserts that the prioritization of efforts to reduce environmental harms in environmental justice communities must be consistent with the Climate Leadership and Community Protection Act (CLCPA).
