Dear Mr. Morgenthau:
On behalf of the New York Civil Liberties Union, we write to request a meeting with you to discuss potential dismissal of certain prosecutions arising out of arrests during the Republican National Convention. As you may be aware, we have questioned the lawfulness of a number of these arrests, particularly of persons arrested on public sidewalks. We contacted your office during the Convention requesting the dismissal of one set of these arrests and now wish to meet with you to review evidence we believe proves these cases should be dismissed.
This past Friday we obtained a videotape of the sequence of events leading to the arrest of approximately 200 people on Fulton Street near the World Trade Center site on August 31, 2004. Confirming what a member of our staff personally observed, the videotape shows that those arrested acted in an entirely lawful manner and were doing nothing more than marching on the sidewalk as directed by an NYPD chief. We would like to review this videotape with you to see if it will persuade you now to direct the dismissal of these cases.
Given that those arrested at this event soon will be required to appear in court, we would like to meet with you at your earliest convenience.
