The cases involve NYCLU’s challenge of policing practices at the February 15, 2003 anti-war demonstration in New York. Dunn is counsel for the plaintiffs in the cases, and the NYCLU was concerned that the city was seeking to depose him as part of an effort to derail the cases by trying to disqualify Dunn from serving as counsel.
In rejecting the City of New York’s effort, the judge recognized that the information sought by city attorneys from Dunn either could be obtained from other sources or was not relevant to the case.
