NEW YORK – Today, a New York appellate court granted the New York Civil Liberties Union’s motion seeking a preliminary injunction against Nassau County’s anti-trans sports ban. The order bars Nassau County from enforcing its local law banning transgender girls and women from participating in girls’ and women’s sports at county-run facilities while litigation continues.
Days ago, on October 6, a Nassau County Supreme Court upheld the county’s trans sports ban. Today’s ruling, which comes from a higher court, bars the county from enforcing the policy while litigation continues.
In response, New York Civil Liberties Union Staff Attorney Gabriella Larios and Long Island Roller Rebels President Curly Fry released the following statements:
“Trans people deserve to be treated with dignity and respect, just like anyone else. Today the appeals court affirmed that fundamental right and swatted down Nassau County’s transphobic ban,” said Gabriella Larios, staff attorney at the New York Civil Liberties Union. “The appellate court made it crystal clear that any attempt to ban trans women and girls from sports is prohibited by our state’s antidiscrimination laws. As attacks against LGBTQ+ rights are on the rise nationwide, we won’t stand for this hatred in New York. This ban is nothing less than a cynical effort to shut trans people out of public spaces, and we are confident that the court’s ruling will be implemented without delay.”
“We are thrilled the Court saw through Nassau’s transphobic and cruel ban,” said Curly Fry (they/them), president of the Long Island Roller Rebels. “The ruling recognizes what we already knew – trans people belong everywhere, including in sports. Nassau County tried to erase members of our community from the sport they love, but we refused to let that happen. We are proud to roll forward together, stronger than ever.”
