Comments on CMS Medicaid Coverage Rule

The New York Civil Liberties Union submitted the following comments in strong opposition to The Proposed Rule by the Centers for Medicare & Medicaid Services entitled Medicaid Program; Prohibition on Federal Medicaid Funding for Sex Trait Modification Procedures Furnished to Children and Youth, RIN 0938, CMS-2451-P. The proposed rule would prohibit federal Medicaid from covering gender-affirming care for transgender people under the age of 19, while permitting coverage for the same care when delivered to intersex young people (often without their knowledge or assent) and cisgender young people who may require it to treat precocious puberty or late onset of puberty, among other conditions.
